Plaintiffs Seek to Lift Stay on MSR Sale by Gander Used in Mass Murder


Although litigation against companies in bankruptcy is normally stayed, the plaintiffs in a suit involving the sale of a Bushmaster to a straw purchaser by Gander that was later used to kill and injure a number of firemen are asking to court to let their suit against Gander proceed because they claim they are not seeking payment from Gander’s bankruptcy estate. They argue that they will only look to recover actual damages from Gander’s insurance company on this particular case, and will remain an unsecured creditor for any punitive damages awarded.
